General Terms & Conditions of Enrolment – Attendee Agreement

Engagement

  • Congratulations on securing your place to attend your chosen Course. By accepting these terms, a binding agreement shall arise between you and Ethics And Passion Pty Ltd (ACN 124 326 325) (GeorgeMihos.com) which shall be governed by the laws of Victoria and the parties submit to the non-exclusive jurisdiction of the courts of that State.

  • Any Course details set out in the GeorgeMihos.com website and Course Special Conditions are incorporated into this agreement by reference. It is your responsibility to inform yourself of the terms. By agreeing to this document, you are deemed to have accepted and understood as binding on you all terms and any accompanying risks, obligations and responsibilities.

Transfers, Refunds and Cancellations
  • You may switch from your chosen Course to another Course without charge by giving GeorgeMihos.com at least 15 business days prior written notice. Transfer notices received within 15 business days of the chosen Course will attract the administrative switching fee set out in the Special Conditions.

  • You may transfer your attendance at your chosen Course to a relative or a friend subject to your written request to do so being received by GeorgeMihos.com and being approved by GeorgeMihos.com beforehand.

  • You are not entitled to a refund of any money before your attendance at your chosen Course as your request for attendance is a purchase order. Once your request for attendance is sent to GeorgeMihos.com or you pay your attendance fee or deposit, you cannot cancel, change or otherwise reject the agreement made between you and GeorgeMihos.com. Refunds and transfers are allowed only as expressed in this Agreement and described in more detail in clause 6.

  • GeorgeMihos.com will refund the payment made only if:

    (a)
    the Event or Course is cancelled and cannot be re-scheduled;

    (b)
    the date of the Event is changed; or

    (c)
    you are entitled to a refund by virtue of the operation of the Trade Practices Act 1974 (Cth), the Fair Trading Act 1999 (Vic) or equivalent State legislation.

  • If a Session is rescheduled to another date, you may either:

    (a)
    use your existing admission for the rescheduled Event if the venue has not changed; or

    (b)
    subject to the payment of any difference in Course Fees, transfer to an alternative event
  • You cannot obtain a refund if:

    (a)
    after an Event has started it is cancelled for any reason;

    (b)
    the time of, speakers, or sessions included in an Event change after the date you purchased your booking;
    (c)
    the participants in a workshop, retreat, Event or Course change at any time without notice, whether through unavailability, injury, illness or for any other reason;

    (d)
    you experience a change in personal circumstances; or

    (e)
    you change your mind.

    (f)
    the participants in a workshop, retreat, Event or course fail to fully attend all sessions

Investment and Payment
  • By accepting these terms you agree to pay the course fee (plus GST if applicable) (Course Fee) for the course you have selected under this Attendee Agreement (Course) subject to the following conditions and any Special Conditions hereto.

  • Your payment of the Course Fee will entitle you to attend the Course and to receive and any materials distributed for your personal use (Course Materials).

Time and Place
  • To gain entry to your chosen Course you must produce at least one form of photo identification at the time of initial registration.

  • You accept that GeorgeMihos.com may find it necessary to change the identity of presenters, the location of the Course and the start and finish times for the Course. If any such change in the Course becomes necessary, GeorgeMihos.com will notify you in writing of the change and you acknowledge that:

    1. GeorgeMihos.com shall not be liable to you as a consequence of the change; and
    2. you shall not be entitled to make any claim for compensation against GeorgeMihos.com
  • GeorgeMihos.com is not liable to you for any loss or damage you suffer as a result of the Course or any Session being cancelled, postponed or changed. This provision does not affect your entitlement to a refund or transfer as provided for in these Conditions.

Intellectual Property
  • GeorgeMihos.com retains all right, title and interest in all intellectual property used in or arising from the performance of the Course, including in the Course Material. In performing the Course, GeorgeMihos.com does not transfer its right, title and interest in any intellectual property to you.

  • You must not:

    1. copy or reproduce any Course Material or supply the Course Material to third parties;
    2. photograph, tape or otherwise record any of the Course and you agree that if you do so or attempt to do so, then any visual or audio recording device used by you will be confiscated and will become the sole property of GeorgeMihos.com.
  • You authorise GeorgeMihos.com to photograph, tape or otherwise record the Course and use the visual or audio recording of the Course for any purpose it may require, including, without limitation, marketing and promotion of its services.

Disclosures
  • You acknowledge that:

    1. the information presented at the Course is for educational purposes only and is not provided as financial advice, personal, general or otherwise;
    2. you will not act on nor rely upon the information provided to you at the Course without first obtaining independent financial and legal advice from licensed advisors; and
    3. independent presenters and the GeorgeMihos.com Success Mentors may contribute to defray to costs associated with staging the Course.
Limitation of Liability
  • GeorgeMihos.com and its directors, employees, presenters, facilitators and representatives disclaim all and any liability to you in respect of any consequential loss or damage suffered or sustained by you in any way arising out of the information disclosed at the Course or in the Course Materials.

Trade Practices
  • Nothing in these Terms and Conditions excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified, which may include Part V of the Trade Practices Act 1974 (Cth), the Fair Trading Act 1999 (Vic) and corresponding provisions of State or Territory legislation which contain provisions including implied terms and warranties which operate to protect the purchasers of goods and services in various circumstances.

  • If any condition or warranty is implied into this agreement under the Trade Practices Act 1974 (Cth) the Fair Trading Act 1999 (Vic) or any equivalent State or Territory legislation and cannot be excluded, and GeorgeMihos.com is able to limit your remedy for a breach of such a condition or warranty, then the liability of GeorgeMihos.com for breach of the condition or warranty is limited to one or more of the following at GeorgeMihos.com’s option: (a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or (b) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

Dispute Resolution
  • In the event of a dispute, you agree to abide by the following process:

    1. You will not start arbitration or court proceedings in respect of a dispute arising out of this contract unless you have notified GeorgeMihos.com and given written notice of the details of the dispute.
    2. During the 21 day period after receipt by GeorgeMihos.com of your written notice of dispute each party to the dispute has used its best endeavours to resolve the dispute.
    3. iIf the dispute remains unresolved after 21 days each party to the dispute agrees that the dispute must be referred for mediation in accordance with the mediation rules of the Institute of Arbitrators and Mediators.
    4. Any information or documents disclosed by a party under this clause must be kept confidential and may not be used except to attempt to resolve the dispute.
    5. Each party must bear equally the cost of any mediator engaged.
General
  • This contract constitutes the entire agreement between the parties. Any prior arrangements, agreement, representations or undertakings are superseded.

  • A Course participant is strictly prohibited from soliciting any business whatsoever or selling or marketing any products or services or otherwise attempting to take advantage of any other participants at the Course in any way, shape or form.

  • GeorgeMihos.com at its sole discretion reserves the right to refuse admission to anyone. You must not:

    1. disrupt, interrupt or behave in any manner that may disrupt or interrupt interfere with, distract, obstruct or hinder GeorgeMihos.com or its employees, agents or contractors in the exercise of their powers, functions or duties;
    2. interfere with the comfort of other participants or their enjoyment of the Course;
    3. use indecent or obscene language or threatening or insulting words, or otherwise behave in a threatening, abusive, riotous, indecent or insulting manner;
    4. operate or use a loud hailer, public address system or other broadcast device;
    5. conduct public surveys or opinion polls, without the prior written consent of GeorgeMihos.com.
  • If you disrupt an Event, you may:

    1. forfeit your deposit,
    2. be expelled from the Venue,
    3. be banned from attending further Sessions,
    4. be subject to legal action for any loss and damage caused; or
    5. any combination of (i) - (iv).
  • This contract may not be varied except in writing signed by you and on behalf of GeorgeMihos.com.

  • If any clause in this contract is held by a court to be unlawful or invalid or unenforceable or in conflict with any statute or regulation it shall be severed from the contract and the validity and the enforceability of the other clauses will remain unaffected.

  • Any written notice required to be given by one party to another party under this contract may be given by:

    1. personal delivery;
    2. ordinary pre-paid mail;
    3. facsimile transmission;
    4. electronically by email.
Notice of disclosure of your credit information to a credit reporting agency. (Privacy Act 1988)
  • GeorgeMihos.com respects your privacy. The personal information that GeorgeMihos.com collect from you in relation to the Course or otherwise shall be used for the purpose of your interaction with GeorgeMihos.com. For these purposes, it may be disclosed to GeorgeMihos.com’s affiliates or as otherwise authorised or required by law.

  • You acknowledge and agree that GeorgeMihos.com may give information about you to a credit-reporting agency for the following purposes:

    1. to obtain a consumer credit report about you; and/or
    2. to allow the credit-reporting agency to create or maintain a credit information file containing information about you.
  • The information GeorgeMihos.com may give about you is limited to:

    1. your name, sex, address, date of birth, name of employer, and drivers licence number;
    2. any loan repayments which are in arrears and are overdue by more than 60 days, and for which debt collection action has started;
    3. details of any dishonoured cheques drawn by you for $100 or more, which have not been paid by your banker upon re-presentation.
  • You also acknowledge that a default listing may be recorded against you by a credit reference bureau if you fail to pay monies due under this contract and that such a default listing may have an adverse affect on your credit rating or your ability to obtain credit in the future.

  • You agree that you understand the general nature and effect of this agreement and the obligations and risk, including the risk of forfeiture of your deposit, involved in signing it. GeorgeMihos.com has informed you that if you are in any doubt on these aspects you should obtain independent financial and legal advice before signing this document.
